1. About these terms

These terms are an agreement between you and Tai Kaish, a sole proprietor in Israel ("Charmwise", "we", "us"). By using our website, app or emails (the "Service"), you agree to them. If you don't agree, please don't use the Service.

2. What Charmwise is

Charmwise is a simulator for practising dating-app conversations. You swipe on profiles, chat with them, and get a score and a coach's note on each message you send.

Every profile, photo, name, bio and reply is fictional and generated or written with AI. Any resemblance to a real person is coincidental. Matches are not real, you are not talking to a person, and nobody you chat with can see or receive your messages. Phone numbers shown in chats are fake.

3. AI content

Replies, coach notes, scores and summaries are produced by AI. They can be wrong, inconsistent or unsuitable for your situation. Use your own judgement.

Coaching is general conversation practice. It isn't psychological, relationship, medical or legal advice.

4. Who can use it

You must be 18 or older. Please give an accurate email address so we can save your progress, and don't share access with others.

5. Free plan and Charmwise Plus

The free plan includes 3 practice chats, then 1 more each day. We may change what the free plan includes.

Charmwise Plus is a paid subscription. When it is available, the price, what's included, any free trial and how to cancel will be shown before you pay. Prices include any taxes we are required to charge. A subscription renews automatically until you cancel, and you can cancel anytime before the next billing date. UK and EU customers keep their statutory cancellation rights.

6. Acceptable use

Please don't:

• Write sexual content involving minors, or try to get the AI to produce it
• Use the Service to rehearse or plan harassment, threats or abuse of real people
• Enter real people's private information
• Misuse the Service, scrape it, or try to access it in ways we haven't provided
• Interfere with its security or performance, or work around the free plan's limits
• Use the Service for anything unlawful

7. Our content

The profiles, photos, text, design and brand belong to Charmwise or our licensors. We give you a personal, non-transferable licence to use the Service for your own practice. Please don't copy, redistribute or resell them, or use them to train AI models.

You keep the messages you write. You give us permission to process them to provide the Service, as described in our privacy policy.

8. No guaranteed results

People differ, and real conversations are not the same as practice. We don't promise any particular outcome, match rate or date.

9. Disclaimers

We aim to keep the Service available and working well, but it is provided "as is" and "as available". To the extent the law allows, we disclaim warranties that are not expressly stated in these terms. Nothing here limits rights you have under consumer law that can't be excluded.

10. Our liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and US$100 (£100 in the UK). We don't exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.

11. Ending your access

You can stop using the Service and ask us to delete your information at any time. We may suspend or end access if these terms are seriously or repeatedly broken, and will tell you why where we reasonably can.

12. Governing law and disputes

These terms are governed by the laws of the State of Israel, without affecting mandatory consumer protections where you live. Disputes go to the competent courts in Tel Aviv-Jaffa, Israel. If you live in the UK or EU, you can also bring claims in the courts where you live. Please contact us first; most things can be resolved quickly.

13. Changes to these terms

We may update these terms. If changes are meaningful, we will update the date at the top and tell you in advance by email or in the Service. If you keep using the Service after changes take effect, the new terms apply.
